In order to deependomestic institutions to provideexternal guaranteemanagement reform,supportdomestic institutionsto participate in the internationaleconomic and financial cooperation,according to theState Administration of foreign exchange(meanssilver hair [1996]302 date)(hereinafter referred to as theapproach),the State Administration of foreign exchangehas decided to furtheradjust theinsidemechanismprovides foreign securitymanagement.The relevant issues are notified as follows:
One,the termforeign guaranty,refers todomestic institutions(guarantor)according topeople's Republic of China,people's Republic of China PropertyLawand themeasuresprovisions,in order to guarantee,mortgage orpledge form,to overseasinstitutions(the beneficiary)commitment,when the debtor(territorythe outer body)failsto fulfill contractual obligations,secured by thepeople to fulfill their obligationsorbeneficiaryin accordance with thepeople's Republic of China,people's Republic of China PropertyLawregulation,thecollateral,pledgediscountauction,saleprice first refusalbehavior.
Domestic institutionsto provide external guarantee,if the secured party isoutside the body,but the beneficiaryfor the domestic institution,shall be regarded as a foreign guaranteemanagement,this notice shall apply.
